Market Mingle Terms of Service

1. Introduction
Welcome to Market Mingle. These Terms of Service explain the rules, rights, and responsibilities that apply when you use our website, mobile applications, and related services (together, the “Service”).
By accessing or using Market Mingle, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Eligibility and Accounts
You must be at least 18 years old and have legal capacity to enter into these Terms.
When you create an account, you agree to provide accurate information and keep your login details secure. You are responsible for all activity under your account and must notify us promptly if you suspect unauthorised access. Do not share accounts or register with false details.
You may register with email and password or supported social sign-in (such as Google or Apple). Log out when using shared devices.
We may suspend or terminate accounts for violations of these Terms, fraud, illegal activity, payment issues, or conduct that harms the Service or other users.
3. The Service
Market Mingle is an online grocery marketplace. Depending on features available to you, you may browse products, build grocery lists or budgets, place orders, use wallet or subscription benefits, join school loyalty programmes where offered, and track deliveries.
We use third-party partners for inventory, payments, delivery, and related operations. Your use of those partners’ services may also be subject to their own terms.
4. Products and Availability
Product details, prices, and images are supplied for shopping convenience. We aim for accuracy but do not guarantee that all information is error-free or always current.
Availability may change at any time. We may limit quantities, correct pricing or listing errors, offer suitable substitutes where appropriate, or cancel affected orders and arrange a refund where applicable.
5. Orders and Purchases
Placing an order is an offer to buy the selected items. An order is confirmed only after successful payment (or authorised wallet payment) and confirmation is shown or sent to you.
Orders depend on availability. We may cancel orders when necessary. Once confirmed, changes or cancellations are not guaranteed; contact support as soon as possible if you need help.
6. Pricing and Payments
Prices are shown in Nigerian Naira (₦) unless stated otherwise. Delivery fees and other charges are shown at checkout where applicable.
Payments are processed through licensed payment partners and/or your Market Mingle wallet. We do not store full card numbers. By paying, you confirm you are authorised to use the selected method.
If payment fails, the order may be cancelled. Eligible refunds are processed to the original payment method or wallet, as appropriate, within a reasonable time after approval.
7. Delivery
Deliveries are handled by logistics partners. Times and costs depend on your location, service option, and product availability. Delivery windows are estimates and may be affected by factors outside our control.
You must provide accurate delivery details and be available to receive your order. Market Mingle is not liable for delays or failed delivery caused by incorrect addresses, recipient unavailability, or courier issues beyond our reasonable control. Contact support with your order details if a delivery problem occurs.
8. Subscriptions and Wallet
Where offered, subscription plans may include discounts, wallet bonuses, or other benefits. Fees are billed as described at purchase. Renewals and cancellations follow the terms shown for that plan; subscription fees are generally non-refundable except where required by law or we agree otherwise.
Your wallet may be used to hold funds, receive eligible bonuses, and pay for orders. Wallet balances are non-transferable and may be subject to limits or inactivity rules. Top-ups and refunds involving the wallet follow our payment and verification processes.
9. School Loyalty Programmes
If you join a school loyalty or parent package programme, you must provide accurate school and student information and comply with verification requirements. Benefits, revenue-share or credit arrangements with schools, and related rules are as described in the programme materials and your package terms. Misuse of school linking or verification may result in loss of benefits and account action.
10. Returns and Refunds
Return and refund requests must be made within the applicable period and according to our support process. Perishable groceries and certain other items may not be returnable. Damaged or wrong items should be reported promptly with clear evidence where requested.
Approved refunds are issued after review, typically within several business days, to the original payment method or wallet as applicable.
11. Acceptable Use
Use the Service only for lawful personal shopping and related account activity. You must not:
- Commit fraud or create fake accounts
- Abuse promotions, wallets, loyalty, or school programmes
- Interfere with the Service, scrape data without permission, or attempt to reverse engineer the platform
- Harass others or use the Service for unlawful commercial resale of products obtained through Market Mingle
Violations may lead to suspension, termination, order cancellation, forfeiture of fraudulent balances, and legal action.
12. Intellectual Property
Market Mingle’s branding, software, and content belong to us or our licensors. You receive a limited, personal, non-commercial licence to use the Service. You may not copy or exploit our content without permission.
Feedback or content you submit may be used to operate and improve the Service.
13. Disclaimers and Liability
The Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.
To the maximum extent permitted by Nigerian law, we are not liable for product listing inaccuracies, third-party failures, or delays outside our reasonable control, and our total liability for a claim relating to an order is limited to the amount you paid for the affected order or service.
14. Indemnity
You agree to indemnify Market Mingle against claims, losses, or expenses arising from your misuse of the Service, breach of these Terms, or infringement of others’ rights.
15. Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Courts in Nigeria have jurisdiction over disputes, subject to any mandatory consumer protections that apply to you.
Before formal proceedings, please contact support so we can try to resolve the issue informally.
16. Changes and Termination
We may update these Terms from time to time. The “Last Updated” date will change when we do. Continued use after changes means you accept the updated Terms.
You may stop using the Service and request account deletion at any time (see our Delete Account page). We may suspend or end access for breach, legal reasons, or if we discontinue the Service.
If any part of these Terms is unenforceable, the rest remains in effect.
